The Living Nativity
Privacy Policy
In short: we collect the information we need to process your purchase, provide your benefits, consider your message for Derric Johnson’s Tribute Book, recognize your support, and keep you updated about The Living Nativity. We do not currently use advertising trackers, analytics tools, or tracking pixels, and we do not sell your personal information.
1. Who we are
This website is run by Ruscella Immersive, LLC ("RI," "we," "us," "our"), based in Orlando, Florida, for The Living Nativity project. This policy is part of our Terms and Conditions. Questions about your information can go to info@ruscellaimmersive.com.
2. What we collect
- When you make a purchase or provide supporter information: your name, email address, phone number, city, state, purchase level and amount, transaction status, and a reference number connecting your payment with your selected benefits or submitted message.
- Payment information: Stripe processes your payment details through its secure checkout. RI does not receive or store your complete card number, card security code, or other complete payment credentials.
- When you write to Derric: your submitted message and the name and location information associated with it. If your message includes information about another person, you must have permission to submit it as explained in the Terms. We do not ask supporters to submit photographs for the Tribute Book or website.
- When you contact us: the information you provide, such as your name, email address, phone number, sponsorship interest, relationship to Derric, and message.
- At events: Living Nativity events may be photographed and recorded, including in 360-degree and immersive formats, as described in section 10 of the Terms.
- When you visit the site: Netlify and services used to deliver the website may automatically process limited technical information needed to provide, protect, and troubleshoot the site, such as your IP address, browser and device type, requested pages, access times, referring page, and server or security logs.
3. What we don't do
- We do not currently use advertising trackers, analytics tools, or tracking pixels on this site.
- We do not sell your personal information.
- We do not add Living Nativity supporters to RI’s general marketing list.
If we add analytics, advertising technology, or similar tracking tools in the future, we will update this Privacy Policy to identify the tools, explain the information they collect and how we use it, and provide any notice or choices required by applicable law.
During checkout, your browser may temporarily remember your message so we can show it back to you when you return from Stripe. It is cleared when you return.
4. How we use it
- To process and document your purchase, send receipts, prevent fraud, and provide the benefits associated with your purchase level.
- To consider your message, name, and general location for the Tribute Book presented to Derric Johnson. Messages may also be read aloud or used on project websites, social media, advertisements, and promotional, documentary, or historical materials for The Living Nativity as authorized under the Terms.
- To display your name on the Living Nativity Honor Roll, website, Tribute Book, event materials, advertisements, and related recognition materials as authorized under the Terms.
- To send purchase confirmations, fulfillment notices, project updates, early-access information, event details, and other communications connected with your purchase.
- To show campaign totals, such as the amount raised and the number of supporters. These are totals only and never identify you.
- To place you on the Living Nativity mailing list and tell you about future Living Nativity events, products, opportunities, and related productions. This does not place you on RI’s general marketing list. You may unsubscribe from promotional email at any time.
- To respond to enquiries, administer Living Nativity events, protect the site and our community, maintain financial and business records, enforce our Terms, and comply with legal obligations.
Unsubscribing from promotional email will not prevent us from sending receipts, fulfillment messages, event information, safety notices, or other communications necessary to complete your purchase or provide your benefits.
5. Who processes it for us
We disclose information as reasonably necessary to service providers that help us operate the project and provide your benefits. These providers process information under their own terms and privacy practices or on our behalf, depending on the service:
- Stripe, for payments.
- Netlify, for hosting and form submissions.
- Our email and communications provider, for maintaining the Living Nativity mailing list and sending messages.
- Professional advisers, production partners, event vendors, and other providers when reasonably necessary to administer the project, fulfill benefits, maintain records, protect legal rights, or comply with law.
We may also disclose information when required by law, legal process, or a valid governmental request; to investigate fraud or security concerns; to enforce our agreements; or to protect the rights, safety, and property of RI, the project, our supporters, or others.
6. If the project moves to a new company
We plan to form a new company dedicated to The Living Nativity. If the project, its assets, or its operations move to that company or another successor, personal information connected with the project may move with it so the successor can administer purchases, deliver benefits, operate the project, and keep supporters informed. Any successor receiving that information will be expected to honor this Privacy Policy or provide notice of material changes.
7. How long we keep it
- Purchase and transaction records: kept as long as reasonably needed to provide benefits, resolve disputes, prevent fraud, enforce agreements, and meet tax, accounting, insurance, and legal requirements.
- Living Nativity mailing-list information: kept until you unsubscribe, ask us to delete it, or we no longer need it, subject to any record we must retain to honor your opt-out.
- Messages and recognition materials: kept as needed to create, preserve, promote, and document the project consistent with the permissions granted in the Terms. The physical Tribute Book and materials already printed, distributed, published, archived, or incorporated into completed content may be permanent and may not be removable.
- Enquiries and form submissions: kept for as long as reasonably necessary to respond, maintain appropriate business records, and protect our legal interests.
8. Your choices
Email info@ruscellaimmersive.com and we'll help if you want to:
- ask what personal information we hold about you;
- request correction or deletion of eligible information;
- ask us to stop displaying your message or name on our website going forward; or
- unsubscribe from promotional Living Nativity emails.
We may need to verify your identity before completing a request. We may retain information when reasonably necessary to complete a transaction, provide your benefits, document an opt-out, comply with law, maintain financial records, resolve disputes, enforce our agreements, or protect legal rights. Names, messages, or other material already printed, distributed, published, archived, or incorporated into completed materials may not be removable.
9. Age
Purchases through this site may be made only by individuals who are at least 18 years old and legally able to enter into a binding agreement. We do not knowingly collect personal information through this site from anyone under 18. If you believe a minor has submitted personal information, please contact us.
10. Security
Payments run through Stripe’s secure checkout, and the site is served over an encrypted connection. We use reasonable administrative and technical measures appropriate to the information we handle. No website, transmission, or storage system can be guaranteed completely secure.
11. Changes
If we update this policy, we'll change the effective date above. If a change significantly affects how we use your information, we'll tell supporters by email.
